COMMISSION INFORMATION
By commissioning me in any way, you are agreeing to the terms of service below.Any statement is subject to change if the terms are discussed with me, the artist, prior to the commission.
I. GENERAL TERMS
Please communicate in a clear and concise manner.Preferred communication is through direct messaging and/or email.Provide clear, neat references.Any negative behavior will not be tolerated, and will result in your commission being canceled if this occurs.Failure to follow these guidelines will result in your commission being declined.
II. PAYMENT
The client will receive a watermarked sketch of their commission. Once the piece is approved, full payment must be made for the rendering process to begin (or for the full resolution sketch to be sent in the case of a sketch commission.)Payment is made via Paypal invoice and will be expected within 24 hours upon approval of the sketch. Failure to make the payment within the allotted time will result in commission cancellation and the sketch deleted.Accepted currency is USD only.
III. PROCESS
A work in progress for any given piece will be sent to the client upon request, or when I, the artist, have a question about the commission or to gain approval to make a significant change.The time needed to complete a commission can take up to three months depending on many factors such as;Health, order of commission, complexity, work, school, or family issues.
IV: CUSTOMER SATISFACTION
I will do everything I can to make my clients happy. However, after a commission is finished, only small changes are allowed to be made. Examples are as follows:• Small coloring changes, marking mistakesAny significant changes will come with an extra charge. Examples are as follows:• Outfit change• Outfit addition or subtraction.• Background change.• Anything that would require I, the artist, to completely redraw the artwork.If your reference was unclear to begin with, then minor changes are not allowed without a fee.Make sure to be clear in exactly what you're looking for in your commission. The more details you can provide, the better!
V: COPYRIGHT / USAGE POLICY
I, the artist, hold every right to the produced artwork, not the commissioner. Therefore, I am allowed to use the copyrighted artwork to:• Promote myself within any place or website.• Publish books with.• To display it anywhere to my liking.• Post it wherever I want.The commissioners are allowed to:• Use the copyrighted artwork for personal use only unless agreed otherwise.• Print the artwork, and claim the right of their character(s) but not the artwork itself.• Use the artwork to promote themselves with proper credit given to the artist.If copyright is infringed upon, every right the commissioner has to the artwork will be retracted. The following is considered copyright infringement:• Reproducing or using the copyrighted artwork commercially.• Taking credit for the creation of the artwork.• Removing any watermarks and/or signatures.• Altering the artwork without my, the artist's, consent.
VI. CANCELLATION POLICY
I reserve the right to cancel and refund the money for your commission at any time.The commissioner has no right to cancel or demand a refund from the artist under any circumstances after payment is received.If money has not been sent, the commissioner has the right to cancel the commission.If the commissioner files a chargeback against me, the artist, your right to every artwork I have ever made for the commissioner in question will be retracted.The commissioner will be forbidden to ever commission me, Nightskeyes Art, ever again.The commissioner's name will be publicly posted everywhere I, the artist, wants to for others to watch out for.I, the artist, reserve the right to file a complaint.I, the artist, reserve the right to the money the commissioner has given me.
